No-fault compensation scheme

Pritchard v Racecage Pty Ltd (1996)

A man was killed after being hit by a competitor’s motor vehicle in a race known as the "Cannonball Run".

The race involved cars travelling at high speed on public roads between Darwin and Alice Springs. The dead man was a volunteer race official.

His wife sued the organisers, claiming that they had promised the race would be conducted safely.

She lost the case - the accident occurred in the Northern Territory which had a no-fault compensation scheme for motor vehicle accidents. Such schemes bar common law claims of negligence being brought to court.
